Drug DUI (DUID) in California
DUI charges are not limited to alcohol. Prescription medications, marijuana, and other substances can result in a DUID charge — even if you have a valid prescription and felt perfectly fine to drive.
What Is a Drug DUI?
California Vehicle Code §23152(f) makes it illegal to drive under the influence of any drug — including legal prescription medications, over-the-counter drugs, marijuana (even with a medical card), and illegal substances. Unlike alcohol DUI, there is no per se BAC limit for drugs. The prosecution must prove that the drug actually impaired your ability to drive.
This distinction matters: the presence of a drug in your system does not automatically mean you were impaired. Many substances remain detectable in blood or urine long after any impairing effects have worn off. An experienced DUID attorney can challenge the prosecution's impairment evidence directly.
Drug DUI cases are often more complex than alcohol DUI cases because they rely heavily on the subjective observations of a Drug Recognition Expert (DRE) officer and toxicology results that require expert interpretation.
Common Substances in DUID Cases
Drug Recognition Experts (DRE)
When an officer suspects drug impairment, they may call in a Drug Recognition Expert — a specially trained officer who conducts a 12-step evaluation protocol. DRE evaluations are highly subjective and their conclusions are frequently challenged in court.
We scrutinize DRE certifications, the evaluation protocol, and whether the officer's conclusions are supported by the toxicology evidence. DRE testimony is not infallible — and challenging it effectively can be the key to your defense.
DUID Defense Strategies
- ✓Challenging the DRE evaluation protocol and officer certification
- ✓Retaining independent toxicology experts to interpret blood results
- ✓Distinguishing between drug presence and actual impairment
- ✓Challenging blood draw procedures and chain of custody
- ✓Questioning the basis for the initial traffic stop
- ✓Exploring prescription medication defenses where applicable
